This Privacy Notice for California Residents supplements the information contained in our privacy policy above and applies solely to all visitors, users, and others who reside in the State of California (”consumers” or “you”). Keep it Simple adopted this notice to comply with the California Consumer Privacy Rights Act of 2018 (“CCPA”), the California Privacy Rights Act of 2020 (“CPRA”), and any implementing regulations adopted thereunder. Terms (including defined capitalized terms) used in this California Privacy Notice have the same meanings given in the CCPA and CPRA and the associated regulations, unless otherwise defined. The terms ”Keep it Simple,” “we”, “us”, and “our” refer to the Keep it Simple division of Life is Good Wholesale, Inc. and related or affiliated companies.

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

  1. RIGHT TO ACCESS You have the right to access PI which we may collect or retain about you. If requested, we shall provide you with a copy of your PI which we collect as permitted by law. You also have the right to receive your PI in a structured and commonly used format so that it can be transferred to another entity (“data portability”).
  2. RIGHT TO KNOW You have the right to request that we disclose the following about your PI, as defined by law:
  1. The specific PI we may collect;
  2. The categories of PI we may collect;
  3. The categories of sources from which we may collect your PI;
  4. The business purpose(s) for collecting or sharing your PI;
  5. The categories of PI we may disclose for business purposes; and
  6. The categories of third parties to whom we may sell or share your PI.

iii. RIGHT TO OPT-OUT / DO NOT SELL/DO NOT SHARE MY PERSONAL INFORMATION

Our use of tracking technologies may be considered a “sale”/ “sharing” under California law. Per the CCPA’s definition of “sell” and “share”, we “sell” or “share” the following categories of personal information in order to deliver a more personalized experience and to show you products that we think you’ll be interested in: Identifiers; commercial information; Internet or other electronic network activity; geolocation data. Per the CCPA’s definition of“sell” and “share”, we “sell” or “share” personal information to the following categories of vendors: advertisers and marketing partners, data analytics providers, and social media networks. We do not knowingly “sell” or “share” the personal information of consumers under 16 years of age.

You have the right to direct us to not “sell” or “share” your personal information at any time (the "right to opt-out"). You can make a Do Not Sell/Share request by contacting us at 1-603-594-6155 or Privacy@lifeisgood.com. We will process your Opt-Out request within 15 days and will notify third parties of your request.

You may change your mind and opt back into personal information sales at any time by contacting us at 1-603-594-6155 or Privacy@lifeisgood.com.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

  1. RIGHT TO REQUEST THAT WE DO NOT COLLECT, SHARE, OR DISCLOSE MY SENSITIVE PERSONAL INFORMATION You have the right to limit how your SPI is disclosed or shared with third parties, as defined in the CCPA/CPRA. Please note that Keep it Simple does not sell your sensitive personal information and only shares it for excepted purposes.
  2. RIGHT TO DELETION In certain circumstances, you have the right to request the erasure of your PI. Upon verifying the validity of a deletion request, we will delete your PI from our records, and instruct any service providers or third parties to delete your information, when applicable.
  3. RIGHT TO CORRECT/RIGHT TO RECTIFICATION In certain circumstances, you have the right to request correction of any inaccurate PI. Upon verifying the validity of a verifiable consumer correction request, we will use commercially reasonable efforts to correct your PI as directed, taking into account the nature of the PI and the purposes of maintaining your PI.

vii. ACCESS AND OPT OUT OF AUTOMATED DECISION MAKING INCLUDING PROFILING

Please note that the above rights are not absolute, and we may be entitled to refuse requests, wholly or partly, where exceptions under applicable law apply.

EXERCISING YOUR RIGHTS If you are a resident of California, you can exercise any of your rights as described in this Policy/Notice and under applicable privacy laws by using the contact information provided in this Notice. We will not discriminate against you for exercising such rights. Except as described in this Policy/Notice or provided for under applicable privacy laws, there is no charge to exercise of your legal rights.

Exercising Your Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by completing this data subject rights form, sending us a message on our website, or call us at 1-888-339-2987. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows Keep it Simple to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows Keep it Simple to properly understand, evaluate, and respond to it.

Response Timing and Format Keep it Simple endeavors to respond to a verifiable consumer request within forty-five (45) days of its receipt. If it requires more time (up to 90 days), it will inform you of the reason and extension period in writing.

Keep it Simple will deliver its written response by mail or electronically, at your option.

Any disclosures Keep it Simple provides will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response will also explain the reasons Keep it Simple cannot comply with a request, if applicable. For data portability requests, Keep it Simple will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.

Non-Discrimination

Keep it Simple will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, Keep it Simple will not

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, Keep it Simple may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

Data Retention

Unless you request its deletion, Keep it Simple will retain your information for as long as your account is active, your information is needed to provide you services, or as required to fulfill Keep it Simple’s legal obligations.

Children's Data

We do not knowingly collect, use, sell or share personal information from anyone under the age of 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete the information.

Changes to Our Privacy Notice

Keep it Simple reserves the right to amend this privacy notice at its discretion and at any time. When Keep it Simple makes changes to this privacy notice, it will post the updated notice on the Website and update the notice’s effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.
